Declaration on the Right of Withdrawal in accordance with the FAGG
In accordance with the provisions of the Distance and Off-Premises Contracts Act (FAGG), the consumer is granted the right to withdraw from a concluded contract within 14 days without giving any reason. The following section explains the essential regulations and information obligations that edventure Studios GmbH (hereinafter “edventure Studios”) must observe in the context of this right of withdrawal.
1. Information prior to the conclusion of the contract
1.1. edventure Studios is obligated to inform the consumer about their right of withdrawal as well as all other essential information in accordance with Section 4 (1) FAGG before the contract is concluded. This is done in a clear and comprehensible manner and in a way adapted to the specifically chosen means of communication via the website.
1.2. The mere provision of the information on the website or a comparable platform satisfies the legal requirements in this phase, provided that it is easily accessible and readable for the consumer.
1.3. Alternatively or additionally, this information can already be provided on a durable medium (e.g., via email or PDF download) to fulfill the legal requirements.
2. Provision of the model instructions on withdrawal and the model withdrawal form
2.1. edventure Studios provides the consumer with the legally required model instructions on withdrawal as well as a model withdrawal form. These are defined in the annex to the FAGG (Annexes 1 and 2) and are provided to the consumer accordingly.
2.2. By correctly completing and transmitting these documents, edventure Studios fulfills the information obligations under the FAGG.
3. Confirmation after conclusion of the contract
3.1. After the conclusion of the contract and at the latest before the start of the provision of services, edventure Studios will transmit a confirmation of the concluded contract to the consumer. This confirmation is provided on a durable medium (e.g., via email) and includes:
A notice of withdrawal,
The model withdrawal form,
All information in accordance with Section 4 (1) FAGG.
3.2. If edventure Studios has already provided this information on a durable medium prior to the conclusion of the contract, the obligation to provide it again does not apply.
4. Duration of the right of withdrawal and special provisions
4.1. The withdrawal period begins on the day the contract is concluded. To meet the withdrawal deadline, it is sufficient for the consumer to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
4.2. If the consumer requests that edventure Studios begin the provision of services during the withdrawal period, this request must be stated explicitly. In this case, the consumer loses their right of withdrawal as soon as the service has been fully performed.
5. Provision of the instructions
The legally required instructions on withdrawal and the model withdrawal form can be viewed, downloaded, and printed on the edventure Studios website. Alternatively, this information will be sent to the consumer without delay via email upon request.
